The following Policies form part of these Terms by reference and govern their respective subject matter:

• Privacy Policy (how we collect, use, and protect personal data)

• Return & Refund Policy (eligibility, timelines, and process)

If there is a conflict, the specific Policy controls for its subject area.

You must be at least the age of majority where you live to place orders.

You are responsible for your account credentials and for all activity under your account. Notify us immediately of any suspected unauthorized use.

Acknowledgement of your order is not acceptance. A binding contract forms when we dispatch the item(s) in your order. We may accept or refuse any order at our discretion.

We may cancel all or part of an order (with a prompt refund for the affected items) if, for example, an item is unavailable, we suspect fraud or abuse, payment cannot be authorized, or a material pricing/description error is found.

Preorders/backorders: Dispatch dates are estimates and may change. If a significant delay occurs, we will notify you and offer options.

Prices, currencies, and any applicable taxes/fees are shown at checkout. We use reasonable efforts to ensure accuracy, but if a material error occurs, we may cancel and refund the affected order.

By submitting an order, you authorize us and our payment providers to charge your selected payment method for the full amount shown, including shipping and applicable taxes/fees.

Discounts and promotions are subject to their stated terms, may be modified or withdrawn at any time, and may not be combined unless we say so.

Dispatch: Orders are prepared for shipment within 1–3 business days, excluding preorders and out-of-stock items. See our Shipping & Delivery Policy for delivery estimates and service levels.

Partial shipments: We may ship items in your order separately at no extra cost; each parcel will have its own tracking.

Title and risk of loss transfer to you upon delivery to the shipping address you provide.

Provide a complete and accurate shipping address at checkout. Address changes are only possible before dispatch. After dispatch, changes may not be possible; any carrier intercept or re-route fees (if available) are your responsibility.

Consequences of incorrect/incomplete addresses are handled per our Shipping & Delivery Policy and Return & Refund Policy.

Our Shipping & Delivery Policy sets out how we handle delayed, lost, or “delivered but not received” parcels, and the remedies available (e.g., reship or refund) after defined tracking thresholds. Delivery estimates exclude weekends/holidays and may be extended during peak seasons or events beyond our control.

Eligibility, timelines, conditions, and how to initiate returns/exchanges are set out in our Return & Refund Policy. Nothing in these Terms affects your statutory consumer rights.

We strive for accuracy in product descriptions, but minor variations may occur (e.g., color/finish due to display differences or manufacturing updates).

Safety and medical disclaimer: Products are for personal use and are not intended to diagnose, treat, cure, or prevent any disease. They do not replace professional medical advice. Always read and follow instructions and safety guidance. Discontinue use and consult a professional if irritation or adverse effects occur. Keep devices and accessories away from children unless the product states otherwise.

Compatibility and results: Results and user experience may vary. You are responsible for verifying compatibility with your needs and environment before use.

Purchases are for personal, non-commercial use unless we agree otherwise in writing. We may refuse or cancel orders suspected to be for unauthorized resale.

If you submit reviews, photos, or other content (User Content), you grant NAVANOVA a worldwide, royalty-free, perpetual, irrevocable, transferable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such User Content in any media, subject to applicable law and our Privacy Policy.

You represent you own or control necessary rights in your User Content and that it is accurate and lawful. We may moderate, edit, or remove User Content at our discretion.

The site and its content (text, graphics, logos, icons, images, videos, software) are owned by or licensed to NAVANOVA and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes.

You may not copy, distribute, modify, reverse engineer, scrape, or create derivative works from the site or its content without our prior written consent.

You must not:

• Use the site for unlawful, harmful, or fraudulent activity;
• Infringe intellectual property, privacy, or other rights;
• Upload malware or interfere with the site’s security or operation;
• Scrape, spider, or harvest data without our consent;
• Post content that is defamatory, harassing, obscene, hateful, or otherwise objectionable. We may suspend or terminate access for violations.

The site may link to third-party websites or services. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and may be governed by separate terms.

You agree to comply with all applicable consumer, e-commerce, export control, and sanctions laws in connection with your use of the site and purchases from NAVANOVA. We may refuse, cancel, or delay orders where required for compliance.

Where mandatory consumer protections apply in your place of residence (including in the UK and the United States), those rights are not excluded and prevail over any inconsistent term in these Terms or the Policies.

Except as required by law or expressly stated by us, the site and all content are provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation.

To the fullest extent permitted by law, we disclaim all implied warranties not mandated by statute, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This section does not affect your statutory rights.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

To the maximum extent permitted by law, we are not liable for: indirect, incidental, special, punitive, or consequential losses; loss of profits, revenue, data, goodwill, or business interruption; or losses not reasonably foreseeable.

For product-related claims, and to the extent permitted by law, our total aggregate liability to you will not exceed the greater of: (a) the amount you paid for the product(s) giving rise to the claim, or (b) £100 (or local currency equivalent). This is in addition to, and does not reduce, any non-waivable statutory remedies you may have.

To the extent permitted by law, you agree to indemnify and hold harmless NAVANOVA and its officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the site, or your violation of any law or third-party rights.

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, strikes, wars, epidemics, failures of utilities or telecommunications, carrier delays, or governmental actions. We will use reasonable efforts to minimize the impact and resume performance as soon as practicable.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

If any provision is found invalid or unenforceable, the remaining provisions remain in full force (severability).

Our failure to enforce any provision is not a waiver of that provision (no waiver).

Except as expressly stated, no person other than the parties has rights under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms (third-party rights).

These Terms and the incorporated Policies are the entire agreement between you and NAVANOVA regarding the site and purchases, and replace any prior agreements on the same subject.

We may update these Terms from time to time. The updated version will be posted here with a new “Last updated” date. Your continued use of the site after changes take effect constitutes acceptance.

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by the laws of England and Wales.

You and NAVANOVA agree that the courts of England and Wales will have exclusive jurisdiction, subject to any non-waivable consumer protections that apply in your place of residence (including protections available to consumers in the United States).
